User Agreement & Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Pigeon Pedigree Pro, operated by AlphaCue Technologies ("we", "us", "our"), governing your use of our website, mobile applications, and related services (the "Service").

1. Acceptance of Terms

By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Accounts

• You must be at least 18 years old to use the Service.
• You agree to provide accurate, current information and to keep it up to date.
• You are responsible for safeguarding your password and for all activity under your account.
• Notify us promptly at support@pigeonpedigree.pro of any unauthorised use of your account.

3. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for managing your own pigeon loft records. This license does not permit you to resell, sublicense, or commercially exploit the Service itself.

4. Your Content

You retain all ownership rights to the data and materials you submit, including pigeon records, images, and pedigree certificates ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free license to host, store, process, and display it solely to operate and provide the Service to you — for example, to render pedigree trees, generate PDFs, or display a public share link you create.

You are responsible for Your Content and confirm that you have the rights to submit it and that it does not infringe the rights of others.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload content that is illegal, infringing, defamatory, or that you have no right to share.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Interfere with, disrupt, overload, or reverse-engineer the Service.
• Use automated means to scrape or extract data beyond the features we provide.
• Resell or redistribute the Service without our written permission.

6. AI Scanning Features

The Service includes AI-powered scanning that extracts data from pedigree certificates you upload. AI output may contain errors or omissions. You are responsible for reviewing and verifying all extracted data before relying on it. We do not guarantee the accuracy of AI-generated results.

7. Plans, Billing & Refunds

• The Service offers a free plan and paid subscription plans, as well as one-time bundle purchases. Plan features and prices are shown in the app.
• Paid subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time; access continues until the end of the paid period.
• Payments are processed by Stripe (or the relevant app store). You authorise the applicable charges to your selected payment method.
• Except where required by law or app-store policy, fees are non-refundable. Downgrading or cancelling does not entitle you to a prorated refund.
• We may change plan pricing with reasonable advance notice; changes apply to subsequent billing periods.

8. App Store Terms

If you download our mobile app from the Apple App Store or Google Play, your use is also subject to that store's terms. Where you purchase a subscription through an app store, billing, renewals, and refunds are managed by that store under its policies. These Terms supplement, and do not replace, the applicable app-store terms.

9. Intellectual Property

The Service, including its software, design, logos, and branding, is owned by AlphaCue Technologies and protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. You may not use our trademarks without prior written consent.

10. Termination

You may stop using the Service and delete your account at any time via the Data Deletion page. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On termination, your license ends and your data is handled as described in our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data (including AI-extracted data) will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, AlphaCue Technologies and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.

13. Indemnification

You agree to indemnify and hold harmless AlphaCue Technologies and its affiliates from any claims, damages, liabilities, and expenses arising out of Your Content, your use of the Service, or your breach of these Terms.

14. Governing Law

These Terms are governed by the laws applicable at the principal place of business of AlphaCue Technologies, without regard to conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the competent courts in that location, unless mandatory consumer-protection law in your country of residence provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
